Consumer information & pre-contractual duties

We provide the following information in accordance with the statutory requirements for distance contracts (§ 312d BGB in conjunction with Art. 246a EGBGB). It is primarily aimed at consumers (§ 13 BGB). Entrepreneurs (§ 14 BGB) will find the contractual details in our Terms & Conditions.

2. Essential characteristics of the goods or service
Notory is software for the inventory and management of IT assets, networks, software, licenses, certificates, compliance requirements and for monitoring systems. It is provided either as a cloud-based service (SaaS) or as a self-operated installation (self-hosting). The respective range of functions results from the chosen plan (Community, Basic, Pro, Elite, Enterprise) and the respective product description.
3. Conclusion of the contract
The contract is concluded in accordance with § 3 of our Terms & Conditions: you submit an offer via the order or request form; the contract is concluded upon our confirmation in text form, upon acceptance of an individual offer, or upon commencement of performance.
4. Prices, price components and payment
The prices stated at the time of the order apply. For paid plans, these consist of a plan-dependent base fee and a component based on the number of managed assets. Unless stated otherwise, prices are exclusive of statutory VAT. Payment is made according to the payment methods communicated during the order process or in the offer; billing takes place in advance for the respective contract period.
5. Contract term and cancellation
The term is twelve months by default and renews in accordance with § 5 of the Terms & Conditions. For consumers, a fixed-term contract only renews for an indefinite period and can then be terminated at any time with one month's notice. 6. Right of withdrawal
As a consumer, you have a statutory right of withdrawal. The full withdrawal instructions and the model withdrawal form can be found on the Withdrawal & cancellation page. Please note the information there regarding the early expiry of the right of withdrawal for digital services and digital content.
7. Warranty
The statutory rules on liability for defects apply. Supplementary provisions for entrepreneurs are contained in our Terms & Conditions.
8. Contract language and storage of the contract text
The language available for concluding the contract is German. You receive the contract text (order/offer and these terms) in text form; storage beyond this by us is not necessarily provided. We recommend that you keep the documents for your records.
9. Applicable law and dispute resolution
The law of the Federal Republic of Germany applies; mandatory consumer protection provisions of your country of residence remain unaffected. The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
