Withdrawal & cancellation

On this page you will find all the ways to end a contract for Notory: the cancellation form (cancellation option pursuant to § 312k BGB), the withdrawal instructions for consumers and the model withdrawal form.

1. Cancel a contract

You can cancel your contract at any time in text form, e.g. by e-mail to info@tougetech.de or via the following form. The notice periods result from § 5 of our Terms & Conditions. For consumers: a contract concluded for a fixed term and tacitly renewed can be cancelled at any time with one month's notice. The right to extraordinary termination for good cause remains unaffected. We confirm the receipt of your cancellation and its effective date in text form.

2. Withdrawal instructions (for consumers)

Consumers (§ 13 BGB) have the following statutory right of withdrawal. Entrepreneurs do not have a right of withdrawal.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded.

To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse you all payments received from you without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this repayment we use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

If you requested that the service should begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point at which you notify us of the exercise of the right of withdrawal with regard to this contract, compared to the total scope of the services provided for in the contract.

Early expiry of the right of withdrawal

For a contract for the provision of services, the right of withdrawal expires if we have fully provided the service and only began performance after you gave your express consent and at the same time confirmed your knowledge that you lose your right of withdrawal upon full performance of the contract.

For a contract for the supply of digital content not on a physical medium, the right of withdrawal expires if we have begun performance of the contract after you expressly consented to us beginning performance before the end of the withdrawal period, confirmed your knowledge that by giving your consent you lose your right of withdrawal upon commencement of performance, and we have provided you with a confirmation thereof.
